Or, was it the road less traveled ? Both leading candidates for President, happens to be the same as three years ago, President Biden and former President Trump. Both have been accused of having otherwise "classified" documents and other such material was not properly secured. In either case, Biden had the material in his garage and in Trump's case, the documents were arranged on a floor in home in Mar-A-Lago. Trump, as a former President, was authorized to possess these records. However, the documents in Biden's custody were from time of his in the Senate or as Vice President where he is not authorized. The Documents Case against Trump could send him to prison. That was why Mar-A-Lago compound was raided by the FBI. President Biden, accused of the same level of involvement if not in some context worse, and Special Counsel Robert Hur has said as much, that "the President knew he had the papers, that he was entitled to them."

As an example, the President held un-secured material over Afghanistan. Elsewhere, highly compartmentalized sensitive information were also lay un-secured. If any of this information were disseminated in any fashion, the National Security would be compromised. With such a profound list of violations, one would expect that charges would be filed. However, not in this case. The truth is that President Biden is not former President Trump. So, while Biden is guilty and all but admitted as much, Hur is not bringing charges against Biden because he is a "kindly old man with issues."

In other words, Biden cannot face the full extent of these statute volitions because he could appear as a sympathetic figure in any jury trial. What Hur was discussing was that the President's diminished capacity is on full display. The President did not remember the death of his son, Beau. He could not identify who was President of Mexico as opposed to the President of Egypt. And he was not aware that French President Mitterrand and German Chancellor Helmuth Kohl have passed on.

The conclusion here is that if the President could not stand trial for mis-handling classified materials, why does one think Biden can still be President ? After Hur's report was released, the President held a rare press conference which did nothing to assure anybody. A poor memory, other cognitive deficiencies all seem indications that Biden might not last another week, much less to November.

However, replacing Biden by mechanisms like the 25th Amendment will allow for a President Kamala Harris. If her elevation becomes necessary, what will that do to Biden ? In any event, Biden still has his defenders and removing him will create cleavages in the Democrat Party. As for Biden at that point ? He probably won't rememeber.
