For all discussion that Chief Justice John Roberts has wanted an apolitical Supreme Court, during his tenure, the Supreme Court has been nothing but political in the decisions handed down over the years. Chief among those would be the up holding of Obamacare. Coming in a close second, however, would be decision announced this morning that former President Donald Trump must remain on the Colorado Primary ballot. By extension, the Ruling will also extend to the prohibitions enacted in Maine and most recently Illinois.


It was not that these ballot challenges were rejected by the Court but it was a repudiation of 9-0. Even the so-called Liberal Justices joined with the Majority, rendering a "concurring" opinion, that "a patchwork of eligibility" is not a practical idea. Invariably, Trump made a comment in the aftermath of the Decision. thanking the Court and also took the opportunity to criticize President Biden over things like the border.


In any event, the attempt at election interference by those states in question has been settled. However, there is one more Trump related case that is also on SCOTUS' docket. That is whether Donald Trump has Presidential immunity, his argument being that action taken while in Office, can be charged once one has left. As mentioned, the Court has agreed to hear the case but this Ruling, set to be announced over the summer, could be more problematic.


This has been a good day for Mr. Trump. With the Supreme Court unanimous as it was, with Super Tuesday tomorrow, the former President and probable 2024 GOP Nominee, if not 2024 President, Trump has some momentum going forward. As surmised, Mrs. Haley did win D.C. but that is probably as far as she is going to get. And, for his part, President Biden will give his State of the Union this week, where he will have to perform in his own right.


The Supreme Court is not supposed to be a political instrument but it increasingly has had to rule on political matters. It is why there is the attempt to "pack" the Court. If SCOTUS had a more liberal bent, if the number of Justices were increased, to a liberal-heavy that would allow for more states to be added with reliable Democrat Senators. That will now not happen.
